Grand Jury indicts woman, man for first-degree abuse of child

This week, Bexar County Grand Juries handed down 199 felony indictments.

Marissa Salas and Thomas Torres are charged in separate indictments with assault by intentionally or knowingly causing serious bodily injury to a child by omission. The first count of Salas’ indictment alleges that on June 28, 2022, Salas intentionally and knowingly caused serious bodily injury to a child who was 14 years of age or younger, by striking the child with an object unknown to the Grand Jury, striking the child on an object unknown to the Grand Jury and manner and means unknown to the Grand Jury; and that Salas had a legal duty to act and failed to do so in that Salas failed to seek medical care for the child. 

The second count of the indictment alleges that on June 15, 2022, Salas intentionally and knowingly caused serious bodily injury to the child by striking her onto a hard surface and manner and means unknown to the Grand Jury. 

The third count of the indictment alleges that on June 1, 2022, Salas intentionally and knowingly, by omission, caused serious bodily injury to the child and that Salas had a legal duty to act and failed to do so in that Salas failed to seek medical care for the child. 

The fourth count of the indictment alleges that on June 24, 2022, Salas intentionally and knowingly, by omission caused bodily injury to the child and that Salas had a legal duty to act and failed to seek medical care for the child.

The first count of Torres’ indictment alleges that on June 15, 2022, Torres intentionally and knowingly, by omission caused serious bodily injury to a child who was 14 years of age or younger, and Torres had a legal duty to act and failed to do so in that Torres failed to seek medical care for the child. 

The second count of the indictment alleges that on June 26, 2022, Torres intentionally and knowingly caused serious bodily injury to the child by sucking on her skin with his mouth and biting the child with his mouth.

The Family Violence Division is prosecuting these cases in the 437th District Court. Assault by intentionally or knowingly causing serious bodily injury to a child by omission is a first-degree felony punishable by 5 to 99 years or life in prison and a possible fine of up to $10,000.

Sammy Gutierrez is charged with murder. The indictment alleges that on Dec. 12, 2021, Gutierrez intentionally and knowingly caused the death of Avery Flores by shooting Flores with a deadly weapon (a firearm). The Family Violence Division is prosecuting this case in the 227th District Court. Murder is a first-degree felony punishable by 5 to 99 years or life in prison and a possible fine of up to $10,000.

An indictment is not a finding of guilt. A person charged by indictment is presumed innocent until found guilty beyond a reasonable doubt by a jury or a judge. Because these and potentially other cases are either pending or may be under investigation, we can make no further comment on them.
