This week, Bexar County Grand Juries handed down 253 felony indictments.
Juan Carlos Diaz-De La Cruz is charged in a multiple-count indictment with the following:
- Trafficking a child to engage in sexual conduct: This count alleges that on July 6, 2021, Diaz-De La Cruz knowingly engaged in sexual conduct with a person who was younger than 18 years of age who was trafficked by another person, and, by any means, was caused to become a victim of conduct prohibited by Section 43.05 (compelling prostitution), Section 43.02 (prostitution) and Section 22.0111 (sexual assault), by agreeing to have, and having sexual intercourse and deviate sexual intercourse with said child for a fee;
- Prostitution/other payor of a person <18: This count alleges that on July 6, 2021, Diaz-De La Cruz knowingly offered and agreed to pay another person for the purpose of engaging in sexual conduct, namely sexual intercourse and deviate sexual intercourse with a person who was younger than 18 years of age;
- Sexual assault-child: Two counts of the indictment allege that on July 6, 2021, Diaz-De La Cruz intentionally and knowingly caused the penetration of the sexual organ of a child who was younger than 17 years of age by the sexual organ of the defendant.
The Human Trafficking Division is prosecuting these cases in the 399th District Court. Trafficking a child to engage in sexual conduct is a second-degree felony punishable by 2 to 20 years in prison and a possible fine of up to $10,000.
Antonio Salvador Alsidez is charged with possession of child pornography. The 16-count indictment alleges that on April 26, 2022, Alsidez intentionally or knowingly possessed visual material that visually depicted, and which Alsidez knew visually depicted a child younger than 18 years of age at the time the videos of the child were made, engaging in sexual conduct. The Public Integrity and Cyber Crime Division is prosecuting this case in the 399th District Court. Possession of child pornography is a third degree felony punishable by two to 10 years in prison and a possible fine of up to $10,000.
Dustin Cody McCall is charged with possession of child pornography. The 13-count indictment alleges that on Jan. 25, 2022, McCall intentionally or knowingly possessed with the intent to promote visual material that visually depicted, and which McCall knew visually depicted a child younger than 18 years of age at the time the image of the child was made, engaging in sexual conduct. The Public Integrity and Cyber Crime Division is prosecuting this case in the 227th District Court. Possession of child pornography is a third degree felony punishable by two to 10 years in prison and a possible fine of up to $10,000.
An indictment is not a finding of guilt. A person charged by indictment is presumed innocent until found guilty beyond a reasonable doubt by a jury or a judge. Because these and potentially other cases are either pending or may be under investigation, we can make no further comment on them.
