This week, Bexar County Grand Juries handed down 241 felony indictments.
Amari Daijanea Gardner is charged with murder. The indictment alleges that on May 14, 2021, Gardner intentionally and knowingly caused the death of Anthony Oneal Easterling by shooting Easterling with a deadly weapon (firearm). This case is being prosecuted by the Criminal Trial Division in the 144th District Court. Murder is a first degree felony punishable by 5 to 99 years or life in prison and a possible fine of up to $10,000.
Andres Perez Tarnava is charged with murder. The indictment alleges that on April 26, 2021, Tarnava intentionally and knowingly caused the death of Marisol Klingelhofer by shooting her with a deadly weapon (firearm). A second indictment charges Tarnava with felon in possession of a firearm. The indictment alleges that on April 26, 2021, Tarnava, having been convicted of the felony offense of possession of a controlled substance PG1 4 grams to 200 grams on March 25, 2013, did intentionally and knowingly possess a firearm after the fifth anniversary of Tarnava’s release from supervision under community supervision, parole or mandatory supervision, following conviction of said felony at a location other than the premises at which Tarnava lived, to-wit: a place other than his home. These cases are being prosecuted by the Criminal Trial Division in the 226th District Court. Murder is a first degree felony punishable by 5 to 99 years or life in prison and a possible fine of up to $10,000.
Brandon Garza is charged in multiple indictments. One charges him with continuous sexual abuse of a child. The indictment alleges that on Feb. 20, 2020 through June 11, 2020, when Garza was 17 years of age or older, he committed two or more acts of sexual abuse of a child younger than 14 years of age. Two other indictments charge Garza with promotion of child pornography. Each indictment alleges that Garza intentionally or knowingly promoted by sending through an electronic messaging platform (KiK), or possessed with intent to promote visual material that visually depicted, and which Garza knew visually depicted a child who was younger than 18 years of age at the time the image of the child was made, engaging in sexual conduct. This case is being prosecuted by the Public Integrity and Cyber Crime Division in the 227th District Court. Continuous sexual abuse of a child is a first degree felony punishable by 25 years to 99 years or life in prison and a possible fine of up to $10,000.
Juventino Rivas is charged with failing to stop and render aid resulting in death. The indictment alleges that on Oct. 24, 2020, Rivas intentionally and knowingly drove a vehicle that became involved in an accident that resulted in death to Geanesse Guel, and Rivas did thereafter, knowing said accident had occurred, intentionally and knowingly failed to determine whether a person was involved in the accident and determine whether that person required aid. A second count of the indictment charges Rivas with failing to stop and render aid resulting in serious bodily injury. That count alleges that in the same accident, Rivas intentionally and knowingly failed to determine whether a person was involved in the accident and determine whether that person required aid, and said accident resulted in the serious bodily injury of Isaiah Carrillo. This case is being prosecuted by the Criminal Trial Division in the 290th District Court. Failing to stop and render aid resulting in death is a second degree felony punishable by 2 to 20 years in prison and a possible fine of up to $10,000.
An indictment is not a finding of guilt. A person charged by indictment is presumed innocent until found guilty beyond a reasonable doubt by a jury or a judge. Because these and potentially other cases are either pending or may be under investigation, we can make no further comment on them.
