Man indicted for April 2021 family violence murder

This week, Bexar County Grand Juries handed down 218 felony indictments.

Robert D. Martin is charged with murder. The indictment alleges that on April 25, 2021, Martin intentionally and knowingly caused the death of Crystal Ferguson by strangling Ferguson by impeding the normal breathing or circulation of the blood of Ferguson by applying pressure to her throat or neck. This case is being prosecuted by the Family Violence Division in the 175th District Court. Murder is a first degree felony punishable by 5 to 99 years or life in prison and a possible fine of up to $10,000.

James Barnett is charged with aggravated kidnapping. The indictment alleges that on Feb. 25, 2021, Barnett with the intent to inflict bodily injury on the complainant, did intentionally and knowingly abduct another person by secreting and holding the complainant in a place where he was not likely to be found; and without the complainant’s consent did restrain the complainant so as to interfere substantially with his liberty, by moving the complainant from one place to another. This case is being prosecuted by the Criminal Trial Division in the 226th District Court. Aggravated kidnapping is a first degree felony punishable by 5 to 99 years or life in prison and a possible fine of up to $10,000.

Daniel Martinez is charged with indecency with a child by contact. The nine count indictment alleges that on Jan. 10, 2021, Martinez intentionally and knowingly engaged in sexual contact with three different female children younger than 17 years of age. These cases are being prosecuted by the Family Violence Division in the 437th District Court. Indecency with a child by contact is a second degree felony punishable by 2 to 20 years in prison and a possible fine of up to $10,000.

An indictment is not a finding of guilt. A person charged by indictment is presumed innocent until found guilty beyond a reasonable doubt by a jury or a judge. Because these and potentially other cases are either pending or may be under investigation, we can make no further comment on them.
