A former juvenile detention officer is facing trial on charges he injured a child who was in custody.
Ramon Montanya was indicted by a Bexar County Grand Jury on June 23, 2021, for a charge of assault causing serious bodily injury to a child. The indictment alleges that on June 29, 2019, Montanya intentionally, knowingly and recklessly caused serious bodily injury to a child who was 14 years of age or younger by pulling and grabbing the child’s arm. The indictment also alleges that Montanya knew the mistreatment was unlawful and that Montanya was acting under the color of his employment as a public servant, namely a detention officer.
Montanya was arrested earlier today by the Bexar County Sheriff’s Office as a post-indictment fugitive.
Assault causing serious bodily injury to a child is a first degree felony punishable by 5 to 99 years or life in prison and a possible fine of up to $10,000. This case is being prosecuted by the Civil Rights Division of the Bexar County District Attorney’s Office.
An indictment is not a finding of guilt. A person charged by indictment is presumed innocent until found guilty beyond a reasonable doubt by a jury or a judge. Because this case is pending, we can make no further comment on it.
