This week, Bexar County Grand Juries handed down 219 felony indictments.
Armando Eric Narvaez and Zion Michael Talavera are charged with capital murder – other felony. The indictments allege that on July 30, 2019, Narvaez and Talavera intentionally caused the death of Gemunu Gamarachchilage by shooting Gamarachchilage with a deadly weapon (firearm) in the course of committing or attempting to commit the offense of aggravated robbery of Gamarachchilage. These cases are being prosecuted by the Criminal Trial Division in the 186th District Court. Capital murder is punishable by life in prison without parole or the death penalty.
Jarren Diego Garcia is charged with murder. The indictment alleges that on March 5, 2021, Garcia intentionally and knowingly caused the death of Mark Ramos by shooting Ramos with a deadly weapon (firearm). This case is being prosecuted by the Family Violence Division in the 175th District Court. Murder is a first degree felony punishable by 5 to 99 years or life in prison and a possible fine of up to $10,000.
Walter Kenneth Hawthorne is charged with assault – intentionally/knowingly causing serious bodily injury by omission to a child. The indictment alleges that on Feb. 18, 2021, Hawthorne intentionally and knowingly caused serious bodily injury to Jayla Elizondo, a child who was 14 years of age or younger, and Hawthorne had assumed care, custody and control of the child and failed to do so in that Hawthorne failed to provide food, water and shelter to the child. This case is being prosecuted by the Family Violence Division in the 379th District Court. Assault – intentionally/knowingly causing serious bodily injury by omission to a child is a first degree felony punishable felony punishable by 5 to 99 years or life in prison and a possible fine of up to $10,000.
Miguel Barbosa is charged with failure to stop and render aid – death. The indictment alleges that on Feb. 19, 2021, Barbosa intentionally and knowingly drove a vehicle that became involved in an accident that resulted in death to Marissa Danielle Duran. Knowing the accident had occurred, Barbosa intentionally and knowingly failed to determine whether a person was involved in the accident and to determine whether that person required aid, and said accident resulted in the death of Duran. This case is being prosecuted by the Criminal Trial Division in the 379th District Court. Failure to stop and render aid – death is a second degree felony punishable by 2 to 20 years in prison and a possible fine of up to $10,000.
Luke Christopher Rosemond is charged with aggravated assault with a deadly weapon. The indictment alleges that on March 27, 2021, Rosemond used and exhibited a deadly weapon (box cutter), that in the manner of its use and intended use was capable of causing death and serious bodily injury. Rosemond also intentionally, knowingly and recklessly caused bodily injury to Norma Rosemond by cutting and stabbing Norma Rosemond with said deadly weapon. This case is being prosecuted by the Family Violence Division in the 399th District Court. Aggravated assault with a deadly weapon is a second degree felony punishable by 2 to 20 years in prison and a possible fine of up to $10,000.
Harley Damien Delbosque is charged with failure to stop and render aid – death. The indictment alleges that on Nov. 23, 2020, Delbosque intentionally and knowingly drove a vehicle that became involved in an accident that resulted in death to Jose Manzanales. Knowing the accident had occurred, Delbosque intentionally and knowingly failed to determine whether a person was involved in the accident and to determine whether that person required aid, and said accident resulted in the death of Manzanales. This case is being prosecuted by the Criminal Trial Division in the 379th District Court. Failure to stop and render aid – death is a second degree felony punishable by 2 to 20 years in prison and a possible fine of up to $10,000.
Matthew Louis Guillen is charged with making a terroristic threat to a judge. The indictment alleges that on Feb. 24, 2021, Guillen threatened to commit an offense involving violence to Nick Catoe and that Guillen knew Catoe was a public servant, namely: a judge. Guillen threatened serious bodily injury or death to Catoe with intent to place Catoe in fear of imminent serious bodily injury. This case is being prosecuted by the Criminal Trial Division in the 399th District Court. Making a terroristic threat to a judge is a state jail felony punishable by 180 days to 2 years in jail and a possible fine of up to $10,000.
An indictment is not a finding of guilt. A person charged by indictment is presumed innocent until found guilty beyond a reasonable doubt by a jury or a judge. Because this case is pending, we can make no further comment on it.
