David Lee Oneal is charged with attempted capital murder of a police officer. The indictment alleges that on Nov. 24, 2020, Oneal intentionally and knowingly attempted to cause the death of Bexar County Sheriff’s Office Deputy J. Alba by driving and operating a motor vehicle at and in the direction of the deputy, and said motor vehicle in the manner of its use and intended use was capable of causing death and serious bodily injury, an act amounting to more than mere preparation that tended but failed to effect the commission of the offense of capital murder, having at the time the specific intent to commit the offense of capital murder, and Deputy Alba was a peace officer who was acting in the lawful discharge of an official duty and that Oneal knew the deputy was a peace officer. The indictment also alleges that Oneal, while using a vehicle, did intentionally flee from a person, namely Deputy A. Martinez, a person Oneal knew was a peace officer who was attempting to lawfully arrest and detain him. This case is being prosecuted by the Criminal Trial Division in the 144th District Court.
As of Feb. 1, 2021, there were 9,670 felony cases pending in 10 Criminal District Courts. There were 21,019 misdemeanor cases pending in 15 Criminal County Courts.
“Each week, the number of cases pending trial continues to grow. Jury trials are a vital part of the criminal justice system. They have been on hold since mid-March because of COVID-19. Once jury trials are again permitted, it’s going to take great coordination and patience to make the transition from virtual to in-person hearings. We know that things will not return to the pace we experienced before the pandemic, but we are working every day to prepare cases from when the cases are first filed with us for review all the way to trial preparation,” Bexar County District Attorney Joe Gonzales said.
