For those planning to file a Forcible Detainer (FE&D),  it is very important to read through this section carefully before you proceed to fill out the Complaint for Forcible Detainer.

Limited Jurisdiction

The Justice of the Peace Courts may hear cases for amounts less than $10,000.

When to file

Prior to filing a Complaint for Forcible Detainer to evict a tenant, the plaintiff/ landlord must give the tenant at least three days written notice to vacate unless the parties have contracted for a shorter or longer notice period in a written lease or agreement.

Where to file an Eviction

The complaint must be filed in the precinct where the property relating to the eviction is located.  You may use the convenient online Bexar County JURISDICTION LOCATOR TOOL tool or call the Voter's Registration Office at (210) 335-662 to find what precinct the property's address is located in.

Trial

Either party may request a jury trial within five days of the date of service of the citation.

Appeals

After the hearing, either party has five (5) calendar days to appeal the judgment.

Difficult to Collect on Judgements

Frequently the plaintiff will find it difficult to collect their judgement on past rent due.

Post Judgement Remedies

Writ of Possession and Abstract of Judgement are possible post judgement remedies.
