70 YEAR OLD VETERAN SENTENCED TO 15 YEARS IN PRISON FOR INTOXICATION MANSLAUGHTER

 

 

San Antonio , Texas ; February 27, 2007: 

Bexar County District Attorney Susan Reed announced that Richard Davis, a 70 year old Vietnam veteran, was sentenced today to 15 years in prison by the 187th District Court Judge Raymond Angelini.  Davis was charged with Intoxication Manslaughter arising from the death of Kaci Pollard, age 21.  Ms. Pollard was involved in an automobile collision on Loop 1604 over IH 10 on Feb. 28th 2006.  Pollard and the other motorist were waiting for the police to arrive when Davis rear ended Pollard's vehicle.  The impact caused Pollard's car to lurch forward, striking her, and causing her to fall off the overpass.  Pollard fell more than 50 feet and died at the scene.  Davis had been drinking at a local V.F.W. post and his blood alcohol content was .14 and after the accident.  In Texas, .08 blood alcohol content is considered legally intoxicated.

At sentencing, Davis expressed his remorse and willingness to accept responsibility for his actions.  He asked for probation stressing that he had no prior record and was a recipient of the Bronze Star based on his actions in Vietnam.  He said he would never drink again.  In addition to the 15 year sentence, Judge Angelini entered a finding that a deadly weapon was used, meaning that Davis will be required to serve a minimum 50% of his sentence before being eligible for parole.
