CRIMES AGAINST THE ELDERLY
San Antonio , Texas ; August 4, 2006: Bexar County District Attorney Susan D. Reed announced today that a jury in the 399 th District Court convicted Richard Green, age 38, on three counts of Unauthorized Interception. Richard Green made secret telephone recordings of his wife, Deanna Green, in anticipation of filing for divorce. Since the recordings were without the consent of Deanna Green or her mother, the only other party to the conversation, his actions were in violation of the Texas Penal Code Section 16.02. The recordings were then disclosed to the court appointed psychologist and used by Richard Green in an attempt to influence the psychologist's recommendation in the couple's custody dispute. The jury found the Defendant guilty of intentionally disclosing and using the illegal recording.
Unauthorized Interception is a second-degree felony with a range of punishment between 2 years and 20 years in prison and up to a $10,000 fine. Judge Juanita Vasquez-Gardner of the 399 th District Court will be sentencing the Defendant on September 18, 2006.
