DALLAS MAN CONVICTED OF SOLICITATION OF A MINOR

August 1, 2003

San Antonio, Texas:  Bexar County District Attorney Susan D. Reed announced today that a Bexar County Jury convicted Patrick Alan Hubbard, 36, of Dallas, Texas of the offense of Criminal Solicitation of a Minor.  Testimony revealed that in May of 2001, Hubbard engaged in a series on internet "chats" with an undercover police officer posing as a 14 year old girl.  In the "chats" Hubbard repeatedly solicited the person he believed to be an underage minor for sexual intercourse and oral sex.  The "chats" occurred over a two and a half month period.  Hubbard contacted the "girl" on more than thirty different occasions including "chats", emails, and telephone calls.  Hubbard then planned a meeting with the "girl" and traveled to San Antonio where he was arrested by awaiting undercover officers with the San Antonio Police Department Vice Unit.  Hubbard was arrested on August 7, 2001.

During the trial the defense claimed that despite all of the contacts he never intended to follow through with the plan.  Testimony also revealed that Hubbard hid from his wife the fact the he was under indictment and standing trial in Bexar County.  Hubbard was defended by Dallas criminal defense attorney Robert C. Hinton and San Antonio attorney Jack McGinnis.

The defendant elected to have punishment assessed by the Judge.  The sentencing is set for later this month in the 379th District Court.  Criminal Solicitation of a Minor is a third degree felony punishable by 2-10 years in prison and up to a $10,000 fine.
