San Antonio, Texas, June 11, 2013: Yesterday David Loven, age 60, was sentenced to Life in prison without parole for the offense of Aggravated Sexual Assault of a Child under the age of 6. Loven was also sentenced to an additional 5 Life terms for the offenses of Sexual Performance by a Child, two 20-year terms for Indecency with a Child by Sexual Contact, and eighty 10-year terms for Possession or Promotion of Child Pornography. In each count the jury assessed a $10,000 fine. Loven was found guilty of all 88 counts on Friday, June 7, 2013. The trial judge, the Honorable Maria Teresa Herr of the 186th District Court, ordered that Loven serve all sentences concurrently.
On New Year's Eve 2011, a 5 year-old child made an outcry to her mother that Loven, whom she called "Davy Crockett", had molested her and had taken pictures of her. Loven was a long-time friend of the victim's mother. A search of the defendant's home revealed the defendant had photos and videos of the child exposing her genitals and anus. During their investigation police identified another female victim, now age 21, who had also been molested and photographed by Loven for several years beginning when she was 7 years-old. Evidence of more than 25,000 images of child pornography, including enlarged and framed images of the victims, child erotica, and more than 500 video recordings containing child pornography was discovered in Loven's home. In addition, zip-lock baggies containing children's underwear labeled with the names and ages of Loven's victims were seized. Both victims testified at trial to the numerous acts of sexual abuse perpetrated upon them by Loven. Loven pleaded not guilty by reason of insanity but his plea was not supported by the evidence and therefore, not considered by the jury.
Aggravated Sexual Assault of a Child under 6 is a first degree felony and carries a range of punishment of 25 years to 99 years or Life without parole, and up to a $10,000 fine. Sexual Performance by a Child is a first degree felony and carries a range of punishment of 5 years to 99 years or Life, and up to a $10,000 fine. Indecency with a Child by Sexual Contact is a second degree felony and carries a range of punishment of 2 years to 20 years, and up to a $10,000 fine. Possession or Promotion of Child Pornography is a third degree felony and carries a range of punishment of 2 years to 10 years, and up to a $10,000 fine. Each offense requires an individual to register as a sex offender.
