Commissioner Tommy Adkisson Sponsors Renewal of Curfew Order for Bexar County
Bexar County Commissioner Tommy Adkisson will ask Commissioner Court tomorrow March 24, to renew the Court's Curfew Order to commence April 18, 2009. The Order was first adopted by Commissioner's Court in 1995 and then subsequently renewed in both 2000 and 2006. By state law it must be renewed every three years.
To regulate the movements and actions of persons under 17 years of age in the unincorporated area of the county, Commissioner's Court must adopt a curfew.
This renewal will enforce a curfew during school hours and during the evening from 10 pm to 6 am Monday thru Friday. "My constituents have asked that the Curfew Court be renewed and I am happy to sponsor this court action again for the second time" said Tommy Adkisson, County Commissioner for Precinct Four. Commissioner's Court will hold a Public Hearing on the Court Order starting at 1:30pm in the Commissioner's Court. The public is invited to comment and hear testimony from Justices of the Peace and police agencies who are asking for the renewal of this curfew. "This is the process required by state law which Commissioner's Courts are duty bound to follow".

Sec. 351.903. COUNTY JUVENILE CURFEW. (a) To provide for the public safety, the commissioners court of a county by order may adopt a curfew to regulate the movements or actions of persons under 17 years of age during the period beginning one-half hour after sunset and extending until one-half hour before sunrise or during school hours, or both. The order applies only to the unincorporated area of the county.
(b) This authority includes the authority to:
(1) establish the hours of the curfew, including different hours for different days of the week;
(2) apply different curfew hours to different age groups of juveniles;
(3) describe the kinds of conduct subject to the curfew;
(4) determine the locations to which the curfew applies;
(5) determine which persons incur liability if a violation of the curfew occurs;
(6) prescribe procedures, in compliance with Article 45.059, Code of Criminal Procedure, a police officer must follow in enforcing the curfew; and
(7) establish exemptions to the curfew, including but not limited to exemptions for times when there are no classes being conducted, for holidays, and for persons going to or from work.
(c) If the commissioners court adopts an order under this section, a person commits an offense if the person violates a restriction or prohibition imposed by the order.
(d) An offense under this section is a Class C misdemeanor.
