It is strongly suggested you seek legal counsel for assistance in filing an appeal. The court clerk cannot give legal advice or provide an appeal "form". When an appeal is correctly filed, the case is transferred to County Court for a new trial. The judgment rendered at County Court will overrule the judgment rendered in this Court. If you have any questions, call this Court BEFORE your appeal deadline, at (210) 335-4700 and press Option #2. Appeal Cash Bonds" are NOT accepted at this Court. Once your case has been appealed out of this court, we can no longer assist you. It is your responsibility to contact the Central Filing Office, Civil Appeals Department at the Bexar County Courthouse at (210) 335-2236 for further information. Within five (5) calendar days from the date of filing an appeal,YOU ARE REQUIRED BY LAW to give written notice to all parties of the case that you filed an appeal.
SMALL CLAIMS & CIVIL JUSTICE COURT SUITS (See Rules 571, 572 & 21a, Texas Rules of Civil Procedure) Within ten (10) calendar days (including Saturdays, Sundays & Holidays) from the signed judgment date, file the following:
(1) A Civil Surety Appeal Bond for double the amount of the judgment.* The bond must have the original signatures and addresses of the appellant plus two (2) other individual sureties. The bond must be addressed as "payable to the appellee" (the opposite party). The bond must be conditioned (state) that "appellant shall prosecute his appeal to effect and shall pay off and satisfy the judgment which may be rendered against him on appeal". The filing of a Surety Bond may be waived on Vehicle Towing cases, but all other appeal requirements are mandatory. (NOTE: You are required by law to give written notice, as provided in Rule 21a, within five (5) calendar days from the date of filing the appeal bond to all parties of the case that you have filed an appeal.)
(2) $10.00 transcript fee (money order, cashier's check or cash - no checks) payable to "JP Court Pct. 3".
(3 Optional) $187.00 filing fee (check, money order or cashier's check) payable to "Bexar County Court". This Court will transport the $187.00 filing fee along with the appealed case to County Court for you, however, you have the option of paying it yourself directly to Bexar County Court within their specified time frame.
(OR) Within ten (10) calendar days (including Saturdays, Sundays & Holidays) of the signed judgment date, in lieu of #2 & #3 above, file a legal Affidavit of Inability (see Rule 572); Immediately give a copy to the other party, as they have the right to contest the affidavit. If contested, a hearing will be held and the Judge will approve or deny the affidavit.
(*) Exceptions: The appeal bond amount on a "TAKE NOTHING" &/or "DISMISSED" judgment is $250.00. A judgment is final and not appealable on a suit filed for less than $250. |
